Mohbad’s Father Takes Legal Action to Overturn DPP’s Decision on Son’s Death

The battle for justice in the mysterious death of Nigerian singer Mohbad has taken another turn as his father, Joseph Aloba, moves to challenge the legal advice and decision of the Lagos State Director of Public Prosecutions (DPP).

Aloba Heads to Court

Mr. Aloba has filed an application before the Ikeja State High Court, seeking to nullify the DPP’s legal advice that led to the acquittal of key suspects in his son’s case. Acting on behalf of himself and the Aloba family, he is taking on Lagos State Attorney General Lawal Pedro (SAN) and DPP Dr. Babajide Martins.

According to court documents, the suit (ID/6197MJR/2025) was filed on March 13, 2025, by his legal representative, Dr. Wahab Shittu (SAN). Aloba argues that the DPP’s legal advice was issued prematurely, denying him a fair hearing as guaranteed under Section 36 of the 1999 Nigerian Constitution.

Key Issues in Aloba’s Legal Challenge

Aloba is raising serious concerns about the handling of the case, highlighting three key issues:

1. Denial of Fair Hearing: He claims the DPP’s decision was made without properly considering all available evidence.

2. Interference with the Coroner’s Inquest: The Coroner’s investigation, which began on September 29, 2023, is still ongoing, yet the DPP preemptively issued legal advice.

3. Acquittal of Key Suspects: The DPP’s recommendation led to the February 26, 2025, discharge of Naira Marley, Sam Larry, Prime Boy, and Pere Babatunde—all of whom have been implicated in the Coroner’s proceedings but are yet to testify.

Did the DPP Jump the Gun?

Aloba insists that allowing the DPP’s decision to stand would undermine the credibility of the Coroner’s Court. He argues that the legal advice effectively obstructs the inquest’s ability to reach an unbiased conclusion.

He also points out that police investigations were forwarded to the DPP without notifying the Coroner’s Court, making it appear as though due process was ignored.

The Fight for Justice Continues

In his sworn affidavit, Aloba calls on the court to intervene, warning that if the DPP’s legal advice is allowed to stand, it could derail the search for justice for Mohbad.

With public outcry still strong over the young singer’s controversial death, all eyes will be on the Lagos State High Court to see whether Aloba’s legal challenge will overturn the DPP’s decision and revive hopes for accountability.
